The bench said “we have actually already accepted the choice taken by the worried Boards to cancel XII standard examination and had put it on record on the previous date”. THE ICSE FORMULA.

In the affidavit, Bhardwaj stated that to standardise the marking, the “overall marks awarded need to remain in consonance with the previous efficiency of the school in Class XII Board Examinations”.

The bench of Justices A M Khanwilkar and Dinesh Maheshwari, while mentioning that there was no question of reversing its earlier decision to accept cancellation of the Class XII board tests by the CBSE owing to the Covid-19 circumstance, accepted the CBSE and ICSE plans for examining outcomes of students on the basis of their performance in Classes XII, XI and X.

Students not satisfied with such an assessment process “will be given a chance to appear in assessments to be performed by the board when conditions contribute for holding the examinations” and “based on this policy, marks scored in later tests,” the CBSE said.

Appearing for some students, Senior Advocate Vikas Singh urged the bench to review the decision of CBSE and ICSE to cancel the tests.
